What California Real Estate Brokerages Should Review Before Their 2027 E&O Renewal

A 2027 E&O renewal should start with the brokerage’s actual operations, not last year’s application. Services, agent count, transaction mix, contracts, claims and cyber exposure may have changed even if the policy looks similar.

Start with what changed in the business

Before renewal, update agent and employee counts, revenue, transaction volume, largest transaction values, property-management activity, commercial work, owned-property transactions and other services.

Review continuity and prior acts

If the brokerage is considering another carrier, confirm the retroactive date, prior-acts protection and prior-knowledge language before replacing a claims-made policy.

Compare the form, not just the premium

Insured services, exclusions, defense-cost treatment, deductible or retention, sublimits and endorsements can matter as much as the liability limit.

Revisit cyber exposure

Real estate businesses continue to depend heavily on email, transaction platforms and electronic documents. Review whether the existing E&O cyber endorsement is adequate or whether standalone cyber coverage deserves consideration.

California context for 2027

California’s broader property-and-casualty market continues to change. The Department of Insurance reported in 2026 that multiple homeowners insurance groups were expanding under the Sustainable Insurance Strategy and that major carriers had filed plans to reopen residential business. Those developments do not predict Real Estate E&O pricing, but they reinforce why California insurance buyers should review current market options rather than assume last year’s conditions still apply.

ECLICK broker perspective

For renewal, we want enough time to compare alternatives without putting continuity at risk. The best time to discover a prior-acts issue, new exclusion or missing service is before the expiring policy is replaced.
