Commercial Real Estate E&O: Why Transaction Size Can Change the Risk
Commercial real estate E&O exposure is not determined by transaction value alone, but larger and more complex deals can increase the severity of alleged financial loss and make policy limits, services and exclusions more important.
Transaction size is one piece of the exposure
A larger transaction can produce a larger alleged loss, but complexity also matters. Leasing, investment sales, development-related activity, environmental issues, valuation questions and sophisticated contracts can create different professional-liability allegations.
Review the insured services definition
The policy should match the commercial services the firm actually performs, including leasing, consulting or property management if applicable.

Limits may deserve a different discussion
A shared aggregate that looks adequate for a residential practice may feel different when the brokerage handles higher-value commercial transactions or has many professionals sharing one limit.
Exclusions can matter more in specialized work
Development, construction, environmental, investment or ownership-related activities may be treated differently by different forms. Disclosure during underwriting is important.
ECLICK broker perspective
For commercial real estate firms, we look at transaction type and professional role, not only the dollar amount. A brokerage acting as a sales agent has a different exposure from one also providing consulting, property management or development-related services.
