How Much E&O Insurance Does a Real Estate Brokerage Need?

There is no single E&O limit that fits every real estate brokerage. Transaction volume, largest transaction size, services performed, contracts, claim history and the way defense costs are handled should all be considered.

There is no universal limit

The appropriate E&O limit depends on the brokerage's operations and risk profile. A small residential brokerage and a larger firm handling commercial transactions, property management or multiple professional services may have very different needs.

Start with transaction exposure

Review annual transaction count, gross commission income, average transaction size and the largest transactions handled. Larger or more complex transactions can increase the potential severity of an allegation.

Consider all professional services

Brokerages that also provide property management, consulting, transaction coordination, mortgage services or other activities should confirm how those services are insured and whether they change the appropriate limit or underwriting requirements.

Contract and client requirements

Some contracts, franchise arrangements, referral relationships or commercial clients may require particular E&O limits. Those requirements should be considered alongside the brokerage's own risk tolerance.

Defense costs can affect usable limits

If defense expenses reduce the policy limit, substantial legal costs can leave less limit available for covered settlements or judgments. Two policies with the same stated limit may therefore provide different practical protection.

Review claim history and growth

Prior claims, rapidly increasing transaction volume, acquisitions, new offices or expansion into new services can all justify revisiting limits rather than simply renewing the same structure each year.

Questions to discuss with your broker

  • What are our annual transaction volume and largest transaction values?
  • Which professional services do we perform?
  • Do contracts require minimum limits?
  • Are defense costs inside or outside the limit?
  • Are any coverages subject to sublimits?
  • Would higher per-claim or aggregate limits better fit our exposure?

The final decision should be based on the brokerage's actual operations, available market options, policy wording and risk tolerance.
